Terms of Service

1. Acceptance of Terms
By accessing or using ComedySpeaker.com ("the Site," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Site. These Terms apply to all visitors, registered users, event planners, speakers, and administrators.
2. Description of Service
ComedySpeaker.com is an online marketplace that connects professional comedy speakers with event planners seeking entertainment for corporate events, conferences, galas, fundraisers, and similar events. We provide a platform for discovery, communication, and booking coordination. We are not a talent agency, production company, or party to any performance contract between speakers and planners.
3. Eligibility
You must be at least 18 years old to create an account or use any paid features. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.
4. User Accounts
- You are responsible for maintaining the confidentiality of your password.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorized use of your account.
- You may not create accounts to impersonate others or for fraudulent purposes.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Speaker Profiles and Listings
Speakers are responsible for ensuring all profile content (bio, photos, videos, testimonials, fee information) is accurate, current, and does not infringe on third-party rights. By submitting content, you grant ComedySpeaker.com a non-exclusive, worldwide, royalty-free license to display and distribute that content on the platform and in marketing materials.
- Profile photos must be real photos of you.
- Video reels must feature your own performances.
- Testimonials must be genuine and accurately attributed.
- Fee ranges must reflect your actual rates.
All new speaker profiles are subject to admin review before going live.
6. Membership Plans and Payments
Speaker memberships are offered at Free, Basic, Pro, and Elite tiers with monthly or annual billing. Payments are processed via PayPal. By subscribing you authorize recurring charges.
- Free Plan: No charge. Access to core profile features.
- Paid Plans: Billed monthly or annually. Annual plans are discounted. See the Pricing page for current rates.
- Cancellations: You may cancel at any time. Access continues until the end of the billing period. No partial refunds.
- Refunds: We do not issue refunds except where required by law.
- Price Changes: We reserve the right to change plan pricing with 30 days advance notice.
7. Bookings and Transactions
ComedySpeaker.com facilitates introductions between speakers and planners. We are not a party to any booking, performance agreement, or financial transaction between users. All terms of performance (dates, fees, cancellations, deposits) are agreed between the planner and speaker directly. ComedySpeaker.com is not liable for disputes arising from such agreements.
When a speaker submits an external lead and a booking occurs through the platform, a commission split is applied as configured by the speaker (between 10% and 90% to the speaker, remainder to the platform). The exact split is displayed on the booking detail.
7B. Performer Payouts & Payment Platform Requirements
Connected Payment Account Required
Performers must connect a valid, active payment platform account (currently PayPal) in their profile settings in order to receive booking payouts. No money is disbursed until a valid payment account is confirmed. This policy applies to PayPal and to any payment platform that ComedySpeaker.com may support in the future.
Payout Accrual — Internal Balance
When a booking payment is received and the performer has not connected a valid payment account, the net performer payout (after platform commission) is held in an internal accrued balance on behalf of the performer. This balance:
- Accrues indefinitely and does not expire.
- Is visible to the performer in their dashboard and to admin in the management panel.
- Is released automatically once a valid payment account is connected and confirmed.
- Is not subject to interest, fees, or penalties while held internally.
- Remains the property of the performer and will be paid out upon connection of a valid payment account.
Payment Account Validation
When a performer enters a PayPal email address, the platform performs an initial domain-level validation (MX record check) to confirm the email domain accepts mail. Full PayPal account ownership is confirmed on the first successful payout. If a payout attempt is returned by PayPal as undeliverable (e.g. the email is not registered with PayPal), the address will be flagged as invalid and payouts will revert to accrual status until a valid address is provided.
Payout Processing Timeline
- Payouts are queued after event completion, subject to a configurable hold period (default: 1 day after payment received).
- Payouts are sent via the connected payment platform to the email address registered in the performer's profile settings.
- Performers may designate a separate payout email that differs from their ComedySpeaker.com login email.
- ComedySpeaker.com is not liable for delays or failures caused by the payment platform.
- If a performer's payment account is closed, frozen, or otherwise unavailable, payouts will accrue internally until a replacement account is provided.
Referral Commission Payouts
When a performer posts a referral lead that converts to a booking, they receive a share of the platform commission as configured in their account settings (the referral split rate, typically 50% of the platform's commission). This referral payout is subject to the same payment account requirements — it will accrue internally if no valid payment account is connected.
Future Payment Platforms
ComedySpeaker.com may add support for additional payment platforms (e.g. Stripe, bank transfer, wire) in the future. The same policy applies to all platforms: no payout is issued until a valid, verified account on the supported platform is connected. Performers will be notified when new payment options become available.
7A. Platform Commission, Compliance & Account Suspension
Commission Obligation
When ComedySpeaker.com facilitates a booking — whether through our direct request system, the lead marketplace, or any other platform-assisted introduction — the performer agrees to pay the applicable platform commission upon completion of the engagement. Commission rates are displayed at the time of booking and are based on the performer's subscription tier. Non-payment of a commission constitutes a material breach of these Terms.
Invoice and Payment Timeline
- Commission invoices are issued automatically following event completion and payout processing.
- Payment is due within the period stated on the invoice (typically 7–14 days).
- Reminder emails are sent at 7, 14, and 30 days past due.
- Performers are responsible for monitoring their registered email address for commission notices.
Account Restriction for Non-Payment
If a commission invoice remains unpaid beyond the allowable period, ComedySpeaker.com reserves the right to restrict the performer's account. Account restriction may take one of two forms at admin discretion:
- Restricted Access: The performer may log in but is confined to a dedicated page showing the outstanding balance, payment instructions, and a means to contact our team. The performer's public profile is hidden, new bookings are paused, and profile editing (including via any assistant links) is disabled until the outstanding balance is settled.
- Full Suspension: Login is blocked entirely. The performer must contact support to resolve the matter before regaining any access.
Restoring Full Access
To restore full account access following a commission-related restriction, the performer must:
- Pay the outstanding commission balance in full via the payment link provided on the account restriction page or by contacting our support team.
- Notify our team by using the message form on the restriction page or by emailing [email protected].
Account restoration is processed within 1 business day of confirmed payment receipt. ComedySpeaker.com is not liable for any losses, missed bookings, or reputational impact resulting from a period of account restriction due to unpaid commissions.
Disputes
If a performer believes a commission invoice is incorrect, they must raise a dispute within 7 days of the invoice date by contacting [email protected] with supporting documentation. Disputed amounts will be reviewed in good faith. During a dispute review, accounts will not be suspended pending a resolution, provided the dispute is raised within the stated window and in good faith.
8. Prohibited Conduct
You agree NOT to:
- Post false, misleading, or deceptive content
- Solicit or accept payment outside the platform to circumvent our fee structure
- Harass, threaten, or abuse other users
- Scrape, crawl, or extract data from the Site
- Upload malware, spam, or unauthorized advertising
- Attempt to gain unauthorized access to any part of the Site
- Create fake reviews or testimonials
- Use the Site for any illegal purpose
9. Reviews and Ratings
Reviews may only be submitted by event planners following a confirmed booking completed on the platform. Reviews must be honest and based on your personal experience. We reserve the right to remove reviews that violate our guidelines, contain offensive language, or are determined to be fraudulent.
10. Intellectual Property
All content on ComedySpeaker.com that is not user-submitted (including design, logos, code, copy, and compilations) is owned by or licensed to ComedySpeaker.com and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
11. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, OR SUITABILITY OF ANY SPEAKER FOR YOUR EVENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMEDYSPEAKER.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY BOOKING MADE THROUGH THE SITE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless ComedySpeaker.com, its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Site, your content, or your violation of these Terms.
14. Account Cancellation & Termination
Termination by ComedySpeaker.com
We may suspend or terminate your account at any time for violating these Terms, for non-payment of commissions, or for any other reason with or without notice. Termination does not relieve you of any obligations incurred prior to termination.
Account Cancellation by User — Request Process
Speakers and event planners may request cancellation of their account at any time. However, account cancellations are processed manually by our admin team — users cannot close their own accounts directly. To request cancellation:
- Log in to your dashboard and navigate to Close Account in the left navigation.
- Submit your cancellation request with a reason. This sends a message to our admin team — your account is not closed immediately.
- Our team will review your request, confirm any outstanding obligations, and process the cancellation. You will receive a confirmation email when complete.
We aim to process cancellation requests within 3–5 business days. If you have any active bookings, pending payments, or outstanding commission balances, these must be resolved before your account can be closed.
Soft Delete & Data Retention
If you have interacted with the platform — including but not limited to placing or receiving bookings, processing payments, participating in event requests, or receiving reviews — your account data will be soft-deleted rather than permanently erased. This means:
- Your login credentials and public profile will be deactivated — you will no longer be able to log in and your profile will be removed from public search results.
- Your email address will be anonymised in our system. We retain a record of the original email for legal and dispute-resolution purposes only.
- All historical records including bookings, event requests, payment transactions, and commission history are retained indefinitely for accounting, legal compliance, and platform integrity purposes.
- Reviews you have written or received remain on the platform attributed to an anonymised account.
Accounts with no recorded interactions (no bookings, events, reviews, or transactions) may be permanently deleted at admin discretion upon cancellation request.
Outstanding Obligations at Cancellation
- Any unpaid platform commissions remain due and collectible even after account cancellation.
- Accrued payout balances owed to performers will be held and released upon provision of a valid payment account, even after profile deactivation.
- Cancellation does not void any performance agreements, booking contracts, or payment obligations between performers and planners.
Irreversibility
Account cancellation is permanent and irreversible. Once processed, the account cannot be restored. If you wish to use ComedySpeaker.com again after cancellation, you must create a new account.
15. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
16. Changes to Terms
We may update these Terms from time to time. We will notify registered users by email of material changes. Continued use of the Site after changes constitutes acceptance of the revised Terms.
17. Affiliate Disclosure
ComedySpeaker.com is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, ComedySpeaker.com earns from qualifying purchases made through links on this site. This includes book links displayed on speaker profile pages. Affiliate links do not affect the price you pay.
